Sex work in the canton of Basel-Stadt (BS)

Basel-Stadt is the only canton with an almost purely urban character and a correspondingly compact sex work scene. Estimated 800-1,200 sex workers, almost exclusively indoors (salons in the Webergasse, Klybeck, Kleinhüningen area). No street prostitute.

Legal situation

Sexarbeit ist legal. Keine personenbezogene Bewilligung. Salon- und Bordellbetreiber unterstehen dem Gastgewerbegesetz und brauchen eine Patentbewilligung. Die Sittenpolizei führt regelmässige Kontrollen durch – nicht zur Schikane, sondern zur Verifikation von Alter, Aufenthaltsstatus und freiwilliger Tätigkeit.

Restricted areas & location rules

Strassenprostitution im gesamten Kantonsgebiet untersagt – Basel war der erste Schweizer Kanton, der Strassen- vollständig durch Indoor-Prostitution ersetzte (Beschluss 1979). Werbung im öffentlichen Raum (Plakate, Auslagen) ist nur in dafür ausgewiesenen Quartieren zulässig.

Registration & permits

Selbstanmeldung bei der AHV-Ausgleichskasse Basel-Stadt. Salon-Mietverträge sollten schriftlich sein und eine klare Tätigkeitsbeschreibung enthalten. EU/EFTA: Anmeldung beim Migrationsamt Basel-Stadt für Aufenthalte > 3 Monaten.

Conclusion
