Stealthing

Secretly removing or damaging the condom during sexual intercourse has been a criminal offense since 2024.

Stealthing refers to secretly removing, damaging or not putting on a condom against the express will of the sexual partner. With the Revision of the Sexual Criminal Law (July 1, 2024) Switzerland has explicitly qualified stealthing as a sexual act without consent - punishable as sexual harassment (Art. 198 StGB) up to rape (Art. 190 StGB), depending on the constellation.

For sex workers this means: Additional bids or threats for unprotected intercourse do not change the legal situation. Anyone who enforces the condom requirement is acting lawfully at all times. Stealthing cases should be reported - advisory centers support the process.
