Stealthing

Secretly removing or damaging a condom during sexual intercourse — a criminal offense since 2024.

Stealthing refers to the secret removal, damage, or failure to use a condom against the explicit will of one’s sexual partner. With the revision of the sexual offenses law (July 1, 2024), Switzerland has explicitly classified stealthing as a sexual act without consent—punishable as sexual harassment (Art. 198 StGB) or rape (Art. 190 StGB), depending on the circumstances.

For sex workers, this means: Offers of extra payment or threats regarding unprotected sex do not alter the legal situation. Anyone who enforces the condom requirement is acting lawfully at all times. Cases of stealthing should be reported—counseling centers provide support throughout the process.
