Swiss Reform Effective July 1, 2024: Broader Definition of Rape, Stealthing Made a Criminal Offense, "No Means No" Model.

The revision of the sexual offense laws took effect on July 1, 2024. Key changes:

  • Expansion of the definition of rape: Men and non-vaginal penetration are now included
  • No Means No: The key element is disregard for the victim’s opposition—silence or freezing is considered a “no”
  • Stealthing is explicitly criminalized
  • Cyber-sexual offenses: Sending unsolicited nude images (“dick pics”) is classified as sexual harassment
  • Increased penalties for groups of perpetrators and particularly vulnerable victims

For sex workers, the reform represents a significant gain in protection: Even within an agreed-upon encounter, any act is only considered consensual if consent is actually given.
